Terms of Service
These Terms of Service (“Terms”) govern all services (“Services”) provided by the Developer (Beatriz Caraballo) to the Client. By purchasing or engaging any Service, the Client agrees to be bound by these Terms.
1. General
The Developer agrees to perform the Services with reasonable skill, care, and diligence. All work will be completed during the Developer’s regular business hours, Monday through Friday (9am to 4pm EST), at the Developer’s discretion. The Developer maintains full discretion over scheduling, workflow, and work methods, provided that agreed delivery timelines are met.
2. Testing and Compatibility
The Developer will test all delivered work using the most recent stable versions of the following browsers:
Google Chrome (desktop and Android)
Mozilla Firefox
Safari (desktop and iOS)
Compatibility with outdated browser versions, Microsoft Edge, or any non-listed browser is not guaranteed. The Developer is not responsible for issues arising from device-specific limitations, third-party platform restrictions, or browser updates released after delivery.
3. Delivery Timelines
Delivery timelines vary by Service:
3.1 The Deep Dive
The Deep Dive deliverable will be provided within forty-eight (48) business hours of payment, excluding weekends and holidays.
3.2 The Buildout
Implementation will be delivered within the timeframe specified after the Deep Dive, typically three (3) to five (5) business days unless otherwise agreed in writing. If additional time is reasonably required, the Developer will notify the Client. Minor extensions will not incur additional fees.
3.3 The Club
The Club is a recurring monthly service providing ongoing guidance and strategic support as requested by the Client. Work is completed at the Developer’s discretion within the month of active subscription. Delivery times for individual requests are not guaranteed and may vary based on work volume, complexity, and availability. This service does not include any implementation work from the Developer.
3.4 Sidekick
The Sidekick is a limited-availability, high-touch monthly service providing ongoing strategic guidance and implementation for requests within scope. Work is completed as efficiently as possible, with prioritization granted to Sidekick Clients. Delivery times for individual requests may vary based on complexity, volume, and available capacity.
4. Walkthroughs
For implementation services (The Buildout and The Sidekick), the Developer may, at their discretion, provide a video walkthrough or written notes as part of the final deliverable. This material is provided for Client convenience and is not guaranteed for every project.
5. Assets and Third-Party Costs
Any fees associated with third-party providers—including fonts, plugins, widgets, libraries, images, or external tools—for which the Developer does not already hold a valid license shall be the sole responsibility of the Client. The Developer is not liable for changes, discontinuations, or limitations imposed by any third-party service.
6. Ownership and Licensing
Upon final delivery and receipt of full payment, the Client receives a non-exclusive, non-transferable license to use the delivered work in unlimited personal or client projects, subject to compliance with all applicable third-party license terms.
Use of any deliverables in commercial products, including but not limited to digital templates, themes, or resellable products, requires a separate commercial license arranged and approved prior to implementation.
The Developer retains all intellectual property rights not expressly granted in these Terms.
7. Support
7.1 The Deep Dive
No post-delivery support is included with a Deep Dive. Follow-up strategy questions, implementation, or troubleshooting require a separate service purchase.
7.2 The Buildout
A ten (10)-day support period begins the day following delivery. This support includes minor refinements, corrections, or bug fixes directly related to the delivered work. Support does not include:
New features
Changes in direction
Requests not outlined in the original Deep Dive
Expansions, additions, or redesigns
Such requests require a separate estimate.
7.3 The Club
The Club provides ongoing access to guidance and strategic feedback. The Club does not include:
Implementations of any kind
Complex functionality builds
Multi-step projects
Dedicated priority delivery
These items require either a Buildout booking or a Sidekick subscription.
7.4 The Sidekick
The Sidekick includes ongoing strategic guidance and implementation for requests that fall reasonably within the Service scope. The Developer retains discretion in determining whether a request is within scope. The Sidekick does not cover:
Requests outside the Developer’s skill set
Work requiring third-party developers
Full-scale redesigns or rebuilds
Requests outside scope may be subject to a separate estimate or may be declined.
8. Refunds
8.1 The Deep Dive
Deep Dive fees are non-refundable, as they compensate for time, expertise, analysis, and recommendations delivered.
8.2 The Buildout
Refunds are available only if requested before work has commenced. In such cases, a partial refund will be issued minus the non-refundable Deep Dive fee. No refunds are issued once implementation work has begun or any part of the deliverable has been provided.
8.3 The Club and The Sidekick
Subscriptions are non-refundable. Clients may cancel at any time, with cancellation taking effect at the end of the current billing cycle. No partial refunds or prorated credits are issued for unused time.
9. Right to Decline or Discontinue
The Developer reserves the right to decline any project or request that:
Falls outside the Developer’s skill set
Is deemed unsafe, unlawful, or technically infeasible
Exceeds available capacity
Violates scope limitations
Requires third-party development or specialized expertise
At the Developer’s discretion, a project may be discontinued if the Client becomes unresponsive, abusive, or engages in scope-creep. In such cases, no refunds will be issued.
10. Amendments
These Terms may be updated or amended at any time without prior notice. The version available at the time of purchase will govern the Service.
